Terms & Conditions
These terms and conditions of business are a contract of mutual agreement between Carl Brookes Driving School (‘us’) and the pupil (‘you’). They formally set out what is expected of each party and the procedure should these expectations not be met.
The pupil
1.0 Licensing
1.1 Pupils must ensure that they have a valid signed driving licence providing UK provisional entitlement to learn to drive a category B motor vehicle and it must be produced to us before the commencement of your first lesson with us.
1.2 You must inform us if you commit any driving offence liable to result in court attendance or endorsements.
2.0 Fitness to Drive
2.1 You must inform us of any disability or injury they may have whether temporary or permanent which may affect their ability to drive.
2.2 You must not commence a lesson whilst knowingly being under the influence of alcohol and/or drugs (illegal, or which may impair driving ability).
2.3 You must inform us if you feel unwell in any way before or during a lesson.
2.4 You must make sure your eyesight meets the minimum legal requirements
3.0 Behaviour
3.1 Carl Brookes Driving School has the right to terminate the lesson at any stage if they feel that it is inappropriate to continue by reason of the pupil’s behaviour, sobriety or state of mind. nn these circumstances the lesson fee is forfeited and it is at the instructors discretion if he or she provides further transport for the pupil.
3.2 Carl Brookes Driving School will not tolerate any form of verbal or physical abuse.
4.0 Postponement or Cancellation of a Lesson.
4.1 You must give a minimum of 48 hours notice of postponement or cancellation of a lesson.
4.2 Late cancellations or postponements will be charged for at the normal lesson rate for the duration of the original booking. nt is to the discretion of Carl Brookes Driving School as to weather or not a refund is issued either partial or in full.
4.3 You have the right to stop receiving lessons from us at any time, subject to conditions 4.1 to 4.2.
4.4 Carl Brookes Driving School will wait for 15 minutes from the start time of the lesson. Beyond this time the lesson will be deemed to have been cancelled and the fee for the entire period of the booking is forfeited.
4.5 Lessons that start late, through the pupil’s fault, will finish at the time of the original booking and will be charged for at the full hourly rate.
5.0 Payment.
5.1 All lessons must be paid for in advance either in cash, by cheque made out to Carl Brookes. Or by bank transfer (details upon request).
5.2 Cheques not cleared by the bank will be charged for; and any such charges will be passed on to the pupil Any lessons or tests booked will not be undertaken until the payment, including additional bank costs, is made and cleared.
5.2.1 Cheques will be of the minimum value of 10 hours tuition .
The instructor.
6.0 Licensing
6.1 Carl Brookes and all other instructors acting on behalf of Carl Brookes Driving School will be legally authorised by the
DVSA to give instruction for reward.
7.0 Behaviour
7.1 Carl Brookes and all other instructors will comply with the DVSA Code of Conduct at all times.
8.0 Postponements and Cancellations
8.1 In the event of the instructor being unable to provide lessons, for whatever reason, We will give as much notice as possible ,Pupils should be aware that it may not be possible to notify them of cancellation if a breakdown occurs on the way to the lesson. Carl Brookes Driving School cannot be held responsible for costs arising from short notice cancellations. If this was part of a prepaid lesson this would be given back to the total lessons owed .
8.2 Carl Brookes Driving School will endeavour to arrive on time for the customer’s lesson. When delayed this time will be added to the original booking.
9.0 Payment
9.1 The cost per lesson for learner driver instruction is currently £30.00 for a manual vehicle and £35 per for automatic vehicle hour or part thereof. Where possible two weeks notice will be given of any price changes. All other block booking / driving test / offers and promotional prices are available on request.
10.0 Assessment and Monitoring
10.1 Pupils may be accompanied on their lesson by a supervising examiner from the DVSA, whose job is to ensure that the tuition given meets the required standard. This is a legal requirement and is in the public interest.
10.2 Carl Brookes Driving School reserves the right to withhold the use of the car for a test or a lesson if in the opinion the pupil is: • Not licensed to drive. • Under the influence of alcohol or drugs. • Medically unfit (including eyesight). • Not at the driving test standard. • Consistently fails to keep or is late for appointments. • Falls into arrears with payment. • For any other reason, Carl Brookes Driving School considers the pupil will be unsafe to handle a motor vehicle.
11.0 Insurance
11.1 All of our cars are fully insured for driving tuition and conduct driving tests.
11.2 No liability of any kind can be accepted by Carl Brookes Driving School for loss of or damage to any property belonging to or in the possession of the pupil.
12.0 Test Applications
12.1 Carl Brookes or any instructor will advise the pupil of the appropriate time to apply for a driving test. The advice will be based on the pupil’s progress to date and the current waiting time for test appointments. It does not imply that the pupil has reached the necessary standard or that the standard will be reached by the appointed test date.
12.2 Carl Brookes Driving School will not hesitate to advise the pupil should it become necessary to postpone their driving test. This condition will avoid expense and unnecessary failure and the delay in waiting for additional tests.
13.0 The Driving Test
13.1 Pupils must ensure that they have all the required documents with them for the driving test. Failure to comply with this condition will mean the examiner will cancel the test and the test, and lesson fees will be forfeited
13.2 Pupils may be accompanied on test by a supervisory examiner whose job is to ensure that the official standards of testing are observed by examiners. This is a legal requirement and is in the interests of the public.
13.3 Pupils may request the examiner to allow the instructor to accompany them on a driving test. This is at the discretion of the examiner. The instructor will not be able to help you in any way during the test.
13.4 The attention of pupils is drawn to the statutory period of notice required by the DVSA for the cancellation or postponement of a driving test.
13.5 Where possible pupils will be told in good time of the advisability of cancelling their test. Carl Brookes Driving School cannot be responsible for the loss of the test fee if you fail to notify the test booking office or for the postponement or cancellation by the DVSA. The telephone number is given on the test appointment form.
13.6 Pupils should note that where lessons, tuition, or vehicle hire are cancelled at short notice, because of a cancellation by the DVSA all fees are forfeited. It may be possible to claim some of the lost fees from the DVSA.
